Public Service Commission seeks to have orders barring removal of DPP Haji set aside

The Public Service Commission (PSC) has requested the High Court to lift the orders that prevented it from proceeding with petitions to remove Director of Public Prosecutions (DPP) Noordin Haji from office over allegations of gross misconduct.

The Commission argued that the orders hindered it from fulfilling its duties and were unfair to other Kenyans with unrelated complaints.

The prohibitory orders, which were issued in October 2021, prevented PSC from considering the petitions lodged by Tob Cohen’s sister Gabriel Van Straten and Ibrahim Ndung’u Ndirangu against Haji over alleged failure to perform his duties by charging a murder suspect.

PSC urged the court to vary the orders so that it can undertake its constitutional mandate and hear the other unrelated petitions. The case will be heard on June 7, 2023, after the parties file their pleadings.
