Kenya’s Authority to Prosecute British Soldiers for Murder Remains Unresolved Despite Renewal of Defence Cooperation Agreement

Despite the renewal of the Defence Cooperation Agreement (DCA) between Kenya and the UK, the question of whether Kenya will have the power to try British soldiers suspected of murder while in the country remains unanswered.

The Kenyan Executive will need to negotiate with its UK counterpart on the implementation of the agreement and reservations made by MPs when they passed it.

MPs passed the cooperation agreement but had reservations, including that British soldiers training in the country who commit murder should be tried locally.

However, these recommendations will not take effect as they were not included in the UK’s version of the agreement.

The ratification of the agreement has been criticised for lack of public participation and failing to address pertinent issues raised by residents of Laikipia.
